Reclusion Perpetua

Bago pumasok sa trabaho kanina, nananood muna ako ng coverage kaugnay ng pagbasa ng desisyon ng Sandiganbayan hinggil sa kaso ni Erap. Palipat-lipat ako sa dalawang malaking network.

Hindi na ako nagulat pa sa hatol. Guilty si Erap sa kasong plunder.

Kapuna-puna lang na ilang saglit lang matapos basahin ang hatol at ang parusang reclusion perpetua, nag-flash kaagad sa abs-cbn na life imprisonment daw ang hatol kay Erap.

Magkaiba ang life imprisonment at reclusion perpetua ayon dito!

"As early as 1948, in People vs. Mobe, reiterated in People vs. Pilones and in the concurring opinion of Justice Ramon Aquino in People vs. Sumadic, this Court already made it clear that reclusion perpetua is not the same as imprisonment for life or life imprisonment. Every Judge should take note of the distinction and this Court expects that henceforth, no trial judge should mistake one for the other."


Normal naman na hindi lahat ay naiintindihan ang pagkakaiba nito, pero ibang usapin na kung malaking media netwook ang magkakamali tungkol dito lalo pa nga at live silang nag-uulat. Itinama naman agad ito ni Atty Danny Concepcion na guest nila.

Update Sept 13, 2007:

Hindi lang naman pala ang abs-cbn ang guilty dito. Halos lahat naman pala ay ganito ang ulat. Pero may paliwanag dito si Jun Bautista ng Sun Star Pampanga.

While the penalty of reclusion perpetua is ordinarily understood as life imprisonment, technically speaking it is not so. It is an imprisonment with indefinite duration but qualifies the convicted person for a mandatory pardon come 30 years. In effect, a life imprisonment may turn out to be longer if the convicted person outlives 30 years because this form of imprisonment is for the duration of his life.

  1. i am not an abs-cbn fun, but i also would like to stressed out that gma network had reports also over the internet of the life imprisonment, i guess lahat ng istasyon even the cnn did commit mistake remember we are not perfect, nadismaya din ako kasi kapuso ako but i had seen it over the internet and even in their radio dzbb.
